Democratic presidential candidate Kamala Harris recently promised that if she ever becomes president, she will implement red flag laws. But what seems to set her apart from many others is the criteria she uses. The Californian believes that seizing guns from white nationalists or any person exhibiting “traits of being a danger to society” could reduce violence in America.
From local officials to members of Congress to the President of the United States, plans are in motion to make Emergency Risk Protection Orders (ERPO’s), commonly called Red Flag Laws, the national norm.
An ERPO order allows for the confiscation by force of all firearms an individual owns. An individual served with an ERPO would lose their firearms for a period between three months and one year.
In Pennsylvania, Red Flag Laws are under serious consideration: even the state’s Republican Senator, Pat Toomey, supports them. In a recent article for the Pennsylvania Post, reporter Ed Mahon listed the eight factors a “judge or hearing officer would be required to weigh” when issuing an ERPO. Each has problems, but taken together they amount to one fact: without committing any crime, ERPO’s allow a judge or hearing officer to strip American citizens of a fundamental and constitutional right.
Senator Bernie Sanders, a Democratic Presidential Candidate that believes he can survive the stress of the Presidency at the young age of 77, just made enemies with gun-wielding Americans. Previously, Bernie Sanders only wanted to ban the next generations from owning “military-style assault weapons”. Now, he wants to take away your guns. It shouldn’t come as a shock to many. After all, bad ideas need a disarmed populace to take effect as the majority of Americans dislike “democratic socialist” policies. After three mass shootings within the past week, Bernie seems to have been pushed further towards authoritarian policies. On Twitter, Bernie Sanders expressed his support for a national gun buyback program.

Sound familiar? It should, because Californian Congressman and former Democratic Presidential Candidate, Eric Swalwell, proposed the same program. Swalwell also took the astounding position that the United States government would just nuke any American that attempted to resist the federal ban and buyback of “assault weapons”, so perhaps this program isn’t what’s best for the American people if all-out war is necessary to squash any dissent.
In 1994 then-Senator Joe Biden, under Bill Clinton’s presidency, passed the Violence Against Women Act. Every five years since then, Congress reauthorizes the act. The bill allowed for the creation of the Office of Violence Against Women within the Department of Justice. It also allocates funding for such. Rep Karen Bass (D-CA) bought the 2019 reauthorization to the floor of the House of Representatives, labeled HR 1585 of the 116th Congress. However, Speaker of the House Nancy Pelosi managed to sneak some red-flag type gun control provisions onto the bill.

New York Democrats passed the states first gun control package since the SAFE Act of 2013 on January 26th, 2019. 30 day waiting periods, bump stock ban, prohibition of teachers carrying in schools, and red flag laws were passed through the state legislature.
New York’s state government is under one-party control. Democrat Andrew Cuomo is in the governor’s mansion and a Democrat majority controls both the state assembly and senate. This democratic-run state government passed all six gun control bills bought to the floor. Most notably is the red-flag law and the dangers associated with the passage of such legislation.
Red Flag Laws
Red flag laws allow family members, school officials or law enforcement to go to a judge, who then can order confiscation of firearms or halt the purchase of. Due process will not be afforded to those subject to such legal interjections.
This type of government power is incredibly dangerous; it is unclear how far the government will go in infringing upon rights, but this gives them the immense potential to do so.
Emotion Clouds Judgement
This yet another example of the all-to-familiar trading of liberties for securities. Obviously, incidents, where there are fatalities as a result of gun violence, are tragic. However, far too often emotion clouds judgment. The mother of a victim of the Parkland shooting appeared alongside Governor Cuomo. “Parkland would’ve never happened if they had a red flag law”, she claims.
Emotion is fueling this fear and hatred of firearms that led to this legislation passing through the state legislature. More often than not, those who fear firearms and advocate for gun control know next to nothing about basic firearm safety. Most have never even held one. And a vast majority fails to understand both the implications of the power red flag laws give the government, as well as the ineffectiveness of such regulations to curbing gun violence. Ignorance breeds fear, and fear breeds hate.
This set of regulations is the first time New York has introduced and passed gun laws since the SAFE Act that followed the Sandy Hook shooting six years ago. With a Democrat-controlled state government, you can bet the next set of gun regulations and stripping of due process will be coming in the near future.
